ACTU provides comment on the model OH&S laws

Following the federal government's plans to harmonise the nation's occupational health and safety laws, the ACTU, the HSU and other unions have been critical of some of the proposed changes that reduce safety at work.
The ACTU on behalf of Unions, has prepared a submission paper on the proposed model legislation.
The submission deals with six main areas:
- The obligation of employers to consult with workers regarding OH&S;
- The role, function and power of democratically elected safety reps;
- Victim's ability to initiate litigation;
- Burden of proof on the prosectution rather than the employer when a workplace accident prosecution takes place;
- Continuing role for Unions; and
- Adequate and equitable opportunity for independent input from employers and employees.
